These Terms of Use (“Terms”) govern your access to and use of the hosting and related services provided by UplinkHosting (“we,” “us,” or “our”). By using our services (“Services”), you agree to be bound by these Terms.

1. Acceptable Use

You agree not to use the Services for any unlawful purpose or in any way that may harm others or interfere with the operation, integrity, or security of our network. Prohibited uses include, without limitation:

  • Hosting, distributing, or linking to content that is illegal under applicable laws.
  • Hosting, distributing, or linking to content that promotes hate speech, violence, harassment, or discrimination against individuals or groups.
  • Sending spam or unsolicited bulk messages; operating open proxies or mail relays used for abuse.
  • Hosting or distributing malware, phishing sites, or other content intended to deceive or cause harm.
  • Attempting unauthorized access to any system, network, or account, or interfering with service to any user or host.
  • Infringing the intellectual property rights of others, including copyright and trademarks.

We reserve the right, in our sole discretion, to determine whether your use of the Services violates this section and to take appropriate action.

2. Termination of Services

We may suspend or terminate the Services, in whole or in part, with or without notice, if:

  • you violate these Terms or our Acceptable Use requirements;
  • your use of the Services poses a risk to us, our network, or other customers;
  • we are required to do so by law or to protect the security and integrity of the Services.

We may also terminate the Services at our discretion for any reason. Termination does not relieve you of any payment obligations accrued prior to termination.

3. Customer Responsibilities

  • You are responsible for ensuring that your content and activities comply with all applicable laws and these Terms.
  • You are responsible for maintaining accurate account and billing information.
  • You are responsible for maintaining your own backups. We are not responsible for data loss resulting from suspension, termination, or service interruptions.

4. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

5. Limitation of Liability

To the fullest extent permitted by law, UplinkHosting will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Services, even if advised of the possibility of such damages.

6. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a new effective date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

7. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict of law principles.
